Terms and Conditions of Sale ("Sales Terms") for Products Purchased from Global-E NL
Effective as of 10 October 2023
These Sales Terms establish the conditions for the sales made between any individual (referred to as “you”) wishing to make a purchase of JET SET products (referred to as “Products”) from the international website www.jetset.ch (the “Online Store”) and Global-e NL B.V., a Dutch company registered under number 72541466, having its registered office at Krijn Taconiskade 430 1087 HW Amsterdam, The Netherlands (referred to as "Global-e", “we”, “our”, “us”) operating as a seller. Global-e is the sales facilitation and e-commerce partner of TOMEA AG, having its registered office at Fortunagasse 15, Switzerland (referred to as “JET SET” or “Tomea”), who is the owner of the JET SET brand and is operating this Online Store, where the Products are made available to you for purchase through the checkout.
These Terms and Conditions form a binding contract between you and Global-e. These Sales Terms do not create any responsibilities or liabilities for TOMEA AG, Fortunagasse 15, Switzerland / JET SET or its affiliates in respect to you.
1. Scope
These Sales Terms only apply to purchases made in the Online Store.
By placing your order to purchase one or more Products (referred to as “Order”) through the checkout, you confirm that you have read and understood these Sales Terms including the Privacy and Cookies Policy (which is available on the checkout) in their entirety, and you agree to be bound by them. These Sales Terms define your legal relationship regarding the checkout, the placement of Orders, and the purchase of Products underlying such Orders.
These Sales Terms may be changed from time to time. The effective date of such change will be stated above. Any changes to the Terms and Conditions will apply to orders placed on or after the effective date.
If you do not agree to the SALES Terms, please do not complete your Order.
These Sales Terms are entered into force in the English language. You agree that any translation, if provided, is available for your convenience only (unless otherwise required by applicable law).
2. Parties
Global-e has an agreement with JET SET, to make JET SET’s Products available to you for purchase from, and delivered by, Global-e. This allows you to buy such Products from Global-e in your local currency and at a price that may include any applicable sales taxes (such as VAT), international delivery costs, import duties, tariffs and similar fees depending on the delivery destination country.
By placing an order via the Checkout ("Order"), you acknowledge that the seller is Global-e and not JET SET, and that upon successful verification by Global-e of your Order and payment information, Global-e will buy the Products from JET SET and resell it to you in accordance with these Sales Terms.
Placing Orders through the Checkout is reserved exclusively for individuals purchasing Products for their own personal use. By placing an Order, you represent and warrant that (i) the Order and purchase of Products thereunder is strictly and solely for your personal use, and not for resale, distribution or any other commercial activities; and (ii) you are legally capable (in terms of age and mental capability) of entering into binding contracts per the local legal requirements in the place where you reside.
3. Browsing, placing orders, payment methods
Browsing for Products is done on the Online Store. Orders are placed through the Checkout by clicking on the "Place Order' button (or similar button). The checkout displays the Products you purchase, the price thereof, international delivery costs and fees ("Delivery Costs"), any applicable import or sales taxes (such as Value Added Tax, Goods and Services Tax, Consumption Tax), and, if available for prepayment, import duties, tariffs and similar costs and fees that may be imposed by the delivery destination (collectively, "Duties and Taxes"). Please make sure you review your Order carefully, identify and correct any input errors prior to placing your Order.
As we offer you the option to purchase the Products in your local or chosen currency, the price of the Products may change from time to time due to exchange rate fluctuations. However, the price, Delivery Costs and Duties and Taxes (if available for pre-payment) of the Products you purchase, will be those that were displayed to you on the checkout at the time you actually placed your Order.
The checkout page will specify the payment methods available for your Order. The availability of such payment methods is dependent on your geographical location.
You acknowledge and agree that: (i) Global-e will use one of its third party payment processors providers ("Payment Processor") to process your payment (while Global-e is acting as the merchant of record), using the payment method you have selected on checkout and it may use the tools, technology or the services of the Payment Processors to process the transaction on its behalf; and (i) you will provide valid and current information about yourself.
If the payment method you selected for the Order supports pre-authorization mechanism (e.g. most credit/debit cards), then when you place the Order, the applicable amount will only be authorized, and you will be charged on the earliest of up to 5 days as of date of Order or once the Product has been dispatched to you.
If the payment method you selected does not support pre-authorization mechanism, the charge will be immediate upon placing the Order (noting however that specific payment methods may support a different timing and we may not know or be in control over such timing, if applicable. Please check your selected payment method's terms of service for more details). Please note that you will be charged the full Order amount even if the Order will be dispatched in parts or if it is a 'pre-order' or similar type of order.
4. Order Processing and Contract Conclusion
Once you have placed your Order, Global-e will promptly acknowledge your Order by sending you an e-mail that will contain the relevant details of your Order.
Please note, this does not constitute Global-e’s acceptance of your Order to buy the Products – it only constitutes our acknowledgement of your Order. Your Order is not accepted (and therefore no commitment is made to sell or provide you with the Products), and no contract for the sale of such Products will come into effect, until you receive an email explicitly stating that the Order has been accepted and confirmed ("Order Confirmation"). The Order Confirmation email is your proof of purchase.
Global-e makes the appropriate efforts to process and fulfil any Order as quickly as possible. However, Global-e may, upon notice to you, decline to accept your Order if: (a) the Products are unavailable (in which case, if the payment was processed, Global-e will refund you in accordance with these Sales Terms); or (b) Global-e is unable to verify the payment information you provided.
Global-e may, if it suspects someone's identity, address, email address and/or payment information is being used fraudulently or in an unauthorised manner, also require additional verifications or information before accepting any Order.
Global-e may choose not to accept Orders in their sole discretion and notably abnormal Orders, Orders which suspected to be placed not in good faith or Orders which have not been placed by individuals. Global-e is not required to provide a reason for declining to accept any Order, though may do so in their sole discretion.
Unless otherwise required by applicable law, we are not required to provide a reason for declining or canceling any Order, though we may do so in our sole discretion.
5. Prices, Shipping and Handling Charges, Taxes and Import Charges
The price charged for a Product will be the price in effect at the time the Order is placed on the Checkout and will be set out in the Order Confirmation email. The price of a Product will appear in your local currency.
Global-e reserves the right to update prices due to variation of the exchange rates between the base currency and your local currency, and you acknowledge that such updates may affect final pricing of the Product. You will be charged according to the applicable exchange rate at the time you actually make your Order on the Online Store.
We may change prices at any time without notice. Price increases will only apply to Orders placed after such changes.
Please note if a pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing, we do not have to provide the relevant products to you at the incorrect (lower) price.
Depending on the delivery destination country prices for the Product(s) may include VAT or other applicable taxes but do not include charges for shipping and handling or Import Charges.
Depending on the delivery destination country separate charges for shipping, handling, Import Charges and their related VAT or other taxes will be shown on the Checkout during the Checkout process and, in any case, on the Order Confirmation email.
You may be offered to pre-pay Duties and Taxes on Checkout. Not all products and not all destinations support prepayment of Duties and Taxes, and we cannot guarantee that your Order will be eligible for such pre-payment. The Checkout will provide details, itemize or indicate if the price paid is inclusive or exclusive of Duties and Taxes before you complete and place the Order.
If Duties and Taxes were not paid when you placed your order, either because you so elected or because pre-payment is not available in the delivery destination (or for any other reason): (a) you are advised that the amount of Duties and Taxes displayed under the pre-payment option on the Checkout is only an estimation and may not reflect the amount of Duties and Taxes actually charged to you by the broker, carrier or the relevant authority, which such amount might be higher than the estimation; and (b) you will be fully responsible for paying all applicable Duties and Taxes directly to the relevant authority as determined and assessed by such authorities. Global-e and JET SET will have no responsibility or liability in connection with the foregoing. Moreover, if you fail to pay any Duties and Taxes without reasonable reason, causing the liability to fall on us, the carrier or any third party (including the JET SET), the amount of such Duties and Taxes may be deducted from any refund or other amounts you may claim.
Global-e may contract with customs brokers or use fiscal representatives to act on its or your behalf for the purposes of clearing the Order into the market. We may also act as, or use our intra-group affiliates as, a 'customs declarant' to clear the Order into the market in our name but on your behalf. Your agreement to these Sales Terms constitutes a consent and authorization for such customs brokers, fiscal representatives or intra-group affiliates to act on your behalf (as an agent, declarant or as otherwise applicable) to: (a) transact with the applicable authorities, (b) complete, submit and execute related documents on your behalf in connection with the import and clearance of Products, (c) facilitate payment of Duties and Taxes and customs clearance; and (d) if applicable, return such Products (subject to these Sales Terms).
You (and not Global-e or anyone on its behalf) will be fully responsible for claiming back any Duties and Taxes from the applicable authority, no matter what the process of payment was thereof, to the extent possible, in cases of a returns or any other eligible circumstances. Global-e and JET SET will have no responsibility or liability in connection with such drawback claim.
If you elected not to pre-pay Duties and Taxes, or failed to pay Duties and Taxes, or refused to accept Product not in accordance with a due cancellation procedure under these Sales Terms, in each case resulting with the Product being returned or need to be returned, then, in addition to the above, you may be liable for the return costs and charges, and may not be reimbursed or refunded for the Delivery Costs paid by you for making the delivery to you. You may also be charged with additional direct or indirect charges resulting from said failure or refusal.
6. Ownership of and risk in Product; Importer of record
Global-e will pass the ownership of the Products ordered to you the moment it dispatches the Products to you (provided you have made full payment of the Products price plus delivery charges and any other charges payable under these Sales Terms, as applicable).
Risk of damage or loss is transferred to you upon delivery to the delivery address specified in the Order (in case you have selected not to pre-pay Duties and Taxes, such location will be deemed to be the port of entrance to the import destination).
YOU WILL BE CONSIDERED AS THE 'IMPORTER OF RECORD' OF THE PRODUCT, AND WE (OR SOMEONE ON OUR BEHALF) WILL ONLY BE FACILITATING THE IMPORTATION ON YOUR BEHALF, AS YOUR AGENT, AND MAY, IN CERTAIN CASES, ACT AS THE 'DECLARANT' FOR THE SOLE PURPOSE OF FACILITATING THE CUSTOMS CLEARANCE (HOWEVER THIS WILL NOT CHANGE YOUR STATUS AS THE IMPORTER FOR PERSONAL USE PURPOSES).
YOU ARE RESPONSIBLE FOR ASSURING THAT THE PRODUCT CAN BE LAWFULLY IMPORTED INTO THE DESTINATION, AND YOU THEREFORE NEED TO COMPLY WITH ALL APPLICABLE LAWS, REGULATIONS, CERTIFICATIONS AND RULES OF THE DESTINATION INTO WHICH YOU IMPORT THE PRODUCT. PLEASE NOTE THE STANDARD FOR USING THE PRODUCT IN THE IMPORT DESTINATION BEFORE ORDERING. PRODUCT ORDERED TO A DESTINATION WITH DIFFERENT STANDARDS CANNOT BE RETURNED FOR THIS REASON AND NO LIABILITY WILL BE ASSUMED IN ANY CIRCUMSTANCES WHICH MAY ARISE FROM PURCHASING PRODUCT WITHOUT THE CORRECT STANDARDS FOR YOUR DESTINATION.
You agree that you will not reexport or re-sell any Product(s) which you have ordered.
Please note that documentation such as packaging, user manuals, product care labels, handling instructions or safety warnings may not be in your language; you may not have available manufacturer's or other service options for the Product or parts thereof; the Product (and accompanying materials) may not be designed in accordance with the standards, product regulations, specifications of the destination to which you import or labelled in accordance with the requirements applicable in your destination, or in yours or the destination's language; if the Product is powered, it may not conform to the destination power parameters such as voltage or other electrical standards (for example you may need to use an adapter to charge your Product).
Any transaction for the purchase of Products under a tax exemption (i.e. by submitting your VAT number) will still be classified by Global-e as a personal import transaction and you hereby agree and acknowledge that items purchased by you under such exemption are purchased for your own use and not for resale.
7. Fulfilment, Handling and Delivery of Orders
You acknowledge and agree that Global-e, or anyone of our third-party fulfilment services providers acting on our behalf (each a "Fulfilment Provider") may handle the delivery and fulfilment of your Order, and that Global-e have sole discretion as to the Fulfilment Provider we choose to use.
Some Products may not be delivered to certain locations or destinations (due to limitations imposed on the Product itself or by the destination). You will be informed of such limitation, either on the Online Store or checkout. The checkout should not permit you to submit your Order if the Product cannot be delivered to your specified address. However, we reserve the right, at any time, to suspend or cancel the delivery of any Product that cannot be legally delivered as such.
Delivery will be completed when the Product is delivered to the address chosen by you as specified when placing your order (in case Duties and Taxes were not paid, that may include the port of entrance to the country destination). Different parts of your order may be delivered on different dates.
Unless otherwise stated, and subject to applicable laws, delivery dates given on Checkout (or on the Online Store) are estimates only. The Order will be delivered by the latest delivery time set out on Checkout (based on the delivery method you selected, if such selection was available for your Order) or, if no delivery time is specified, within 30 days following the Order Confirmation date, unless exceptional circumstances exist (pre-order for example). Delivery timeframes are affected by your delivery address and the delivery method selected. Global-e is unable to specify an exact delivery date and time.
Neither JET SET nor Global-e have liability for any losses arising from delay in delivery to the extent that this is due to circumstances beyond their reasonable control and where neither could have taken reasonable steps to deal with the delay. For example, delays resulting from customs clearance procedures or other actions of relevant authorities are generally outside our control, or delays resulting directly from your actions or omissions.
If you receive notification of an unsuccessful attempted delivery, it is your responsibility to use the details provided to contact the delivery company to arrange re-delivery. If you have selected a delivery method that does not require a delivery to be signed for and nobody is available to receive the Products, we reserve the right to leave them at the doorstep, hall or reception as available.
We encourage you to examine the delivery package and received Product(s) promptly after they are delivered to you and check their condition and that the content of the delivery package is complete. In case of damaged or missing Product(s), please contact JET SET’s Customer Service.
8. Product(s) Availability
We do not guarantee the availability of any Product(s) in the Online Store.
Unless we accepted your Order by sending an Order Confirmation, we reserve the right, without liability or earlier notice, to change, discontinue or to stop making available any Product(s).
9. Compatibility, Product Information
Please take care when placing your Order to ensure that the Product(s) you purchase are compatible for the intended use. Please use the Online Store as your final point of reference when checking compatibility. In the event of a difference between the Online Store content and any other website (or any other source of information) the compatibility of Product(s) as shown on the Online Store at the time of purchase will be seen as taking precedence.
The images of the Products on the Website are for illustrative purposes only. Although we make every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the products. You are advised that there may be minor differences between the actual Products and the way that it appears on the relevant website, e.g., in relation to appearance / color / texture / finish. The labelling or packaging of the Products may differ from the images of these which you see on the Online Store.
10. Payment
You may pay with the payment methods specified at the Checkout. Payment can be made by credit cards identified at the Checkout, Paypal, or such other payment methods (depending on your geographical location). When being charged, the descriptor you will see shall include Global-e identified as ‘Global-e’ and will substantially look like this: **Global-e//JET SET**.
By placing an Order on the Online Store, you acknowledge and agree that: (i) we, or one of our third party payment processors ("Payment Processor"), will charge you through the payment method you have selected in your Order and such other amounts payable under these Sales Terms that may be due in connection with the Order; (ii) you will provide valid and current information about yourself; (iii) we may use the tools, software or services of Payment Processors to process transactions on our behalf; and (iv) you may be charged bank or credit/debit card issuer with additional fees (such as foreign transaction fee or cross border fee) or surcharges imposed by your bank or credit/debit card issuer, and those are not Global-e or JET SET charges or fees, and neither have control over this nor do we have any way to mitigate this, as this is purely up to the relationship and commercial terms between you and your bank or credit/debit card issuer, and we (or JET SET) also have no way of knowing in advance whether you will be charged such fees or surcharges.
Depending on your location, payment may be made to an intra-group affiliate of Global-e, and such payment will constitute a payment to us and will discharge you from your payment obligations in connection with the Order and purchase of the underlying Products.
All payments will be subject to security checks. Therefore Global-e may contact you to confirm your Order information and Order details such as proof of address, proof of address in the name of the person indicated for the delivery address etc.
Global-e takes the safeguarding of your payment details seriously, but we may not be able to prevent, and cannot be held liable for loss you may suffer if a third party procures unauthorized access to your payment details when accessing or ordering from the Online Store.
Payment by Invoice with Klarna: In cooperation with Klarna and in certain jurisdictions only, you may be offered the opportunity to purchase goods using Klarna as a payment method. The terms and conditions which will apply to payment by Invoice with Klarna can be found here, noting that German (not English) are the governing and binding language of such terms and conditions. Eligibility for use of the Klarna invoicing payment method will be determined by Klarna in their sole discretion and we accept no liability in respect of your use of Klarna as a payment method. Where you choose to purchase your goods using payment by invoice with Klarna, you will be sharing your personal data with Klarna and the terms of Klarna privacy policy shall apply to their use of your personal information. Global-e (or JET SET) shall have no responsibility for their use of your personal data.
11. Return and Refund
Please note that Global-e will only process returns and refunds for Product(s) bought from Global-e. JET SET retail stores or other partner stores cannot accept returns for Orders placed on the Online Store.
Cancellation right:
If you have bought Product(s) for your own private use as a consumer and want to exercise your right to cancel the contract and return the Product(s) you may do so during the cancellation period, which will expire 14 days after the day of delivery. This right is not affected by any separate returns policy in these Sales Terms.
To exercise the right to cancel, you must inform Global-e of your decision to cancel your Order by a clear statement using the Global-e Returns portal here and follow the instructions and providing the requested information therein, including providing proof of purchase (your Order identification number and the email address used for the Order), indicating the applicable items to be returned and the quantity thereof and selecting the applicable method of returning the product (if different options are available). You may use the model cancellation form at the end of this document, but it is not obligatory as long as you provide all mandatory information in your communication.
A return Product authorization ("RMA") number will be provided to you (through the portal (if applicable) and via email) and, if applicable, a return shipment label will be generated.
You will then have to send back the returned items or hand those over as per the instructions provided to you in the return portal without undue delay and in any event not later than 14 days from the date on which you notified your decision to withdraw from the contract. The RMA number must be included in the return package.
You may only return Product(s) over which you have taken reasonable care and which are new and not used. Altered Product(s) or Product(s) with missing tags or sealed Products which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery cannot be returned. You will be liable for any diminished value of the Product(s) resulting from your handling of the Product(s) other than what is necessary to establish the nature, characteristics and proper functioning of the Product(s) you bought.
This returns policy is in addition to, and does not affect, the separate legal cancellation right which is available only to EEA Consumers and withdrawal right which is available to UK Consumers.
Return procedure:
You must return the Product(s) in their original package (box, garment bag, etc.). Please pack the Product(s) securely and make sure that your Order number is clearly visible on the outside of the parcel. To ensure fast and secure return we encourage you to follow the given return instructions.
We will refund the price you paid for the Product(s) after receiving the returned products at our warehouse, the actual refund period may vary depending on the payment method you have chosen to use when you ordered. The refund does not include the initial shipping cost charged to you. The refund will be confirmed by email. Payment will be carried out using the same means of payment as you used for the initial transaction.
All returns could be subject to strict quality control to ensure that the returned items satisfy these requirements. If you return item(s) 1) that you are not entitled to return, 2) that you damaged or used in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product(s), or, 3) with Product(s) missing, or 4) have otherwise failed to exercise reasonable care when taking care of and returning Product(s) or 5) that you did not buy directly from us, we reserve the right either to reject your return and decline to refund or to reduce any payments to be refunded to you for the diminished
Title and risk to the returned items will not transfer back or assumed until such items physically arrived back to the returns facility, and therefore you are advised to use a courier service offering tracked service, and to have adequate insurance to cover the cost of the goods in transit.
Other return cases: If the Products you have received do not correspond to the ones you have ordered, or if your delivery is incomplete or damaged in transportation, please contact without delay JET SET’s Customer Service for assistance.
12. Warranties and faulty Products
Please check the products you receive from us for faults immediately on receipt. Products are defective if they arrive damaged or have a material or manufacturing defect. Commercially or technically unavoidable, material-related variations in the quality, colour, size or design of the product do not constitute defects. This also applies to natural wear and tear.
If you believe you are entitled to a warranty, please contact JET SET's customer service at JET SET customer-service@jetset.ch (including information about the order (order number; info delivery note).
Defective products may be repaired or replaced with an identical product. If the product cannot be repaired or the same product is no longer available, you are entitled to a full refund.
For customers resident in the EU, defects occurring within one year of delivery of the product may be claimed within the statutory limitation period of two years from delivery of the goods.
For products shipped internationally, please note that the warranty may not be valid in the destination country, or may be limited in the destination country. If the warranty is valid and not limited by your jurisdiction, the warranty may be claimed no later than one year after delivery of the Products, unless the applicable law provides for a longer period.
Nothing in this section affects your statutory rights under applicable law.
For the avoidance of doubt, defects or damage caused by accidental events or by your negligence, or by your use of the Products other than for their intended purpose, or by normal wear and tear, are not covered by the warranty.
13. Personal Data
Global-e and JET SET have entered into collaboration to be able to offer the Products in your country or region. Both parties process personal data of the customers as data controllers in their own rights. As two separate data controllers neither Global-e nor JET SET control the processing of your personal data by the other party.
Depending on the section of data processing, your personal data is processed in JET SET’s or Global-e’s system area. As part of the purchase process, customer data is processed exclusively in the Online Store and in the JET SET system. Only during the ”checkout process” is customer data transmitted via an interface to the Global-e system area, where further data processing takes place. With this data transfer via the interface into the Global-e system area, the factual influence and responsibility for data processing changes from JET SET to Global-e.

The privacy policies and additional provisions in these Sales Terms govern the use of your personal data and use of cookies.
JET SET will also collect your personal data to be able to ship the Products ordered by you, to facilitate any Product returns and to be able to provide customer service for you. JET SET may also use your personal data for marketing purposes in accordance with applicable laws. JET SET is the data controller of your personal data JET SET collects on JET SET’s own behalf.
Global-e will process your payment of the Products. Global-e will take reasonable care to keep the details of your Order and payment secure, but (in the absence of material negligence on their part) neither JET SET nor Global-e can be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Online Store.
14. Liability
We shall perform our obligations under these Sales Terms with reasonable care and skill.
You should take all reasonable steps and precautions to ensure that the Product(s) you order are suitable for your purposes. You must follow any advice that we give you in relation to Product(s) (including instructions, user guides and/or manuals provided with Product(s)). We or JET SET do not accept liability for damage to Product(s) that we have supplied where caused by your failure to follow our advice.
We shall use our reasonable endeavours to verify the accuracy of information that is used on the Online Store but, subject to applicable law, cannot guarantee that all information will always be accurate and complete. It is possible, for example, that Product images and packaging may not always match Products supplied. If you have any questions or concerns in this regard, please contact us before ordering any Product(s). Also, pricing mistakes may occur from time to time, in which case we may cancel any Orders being processed or accepted by us. We will correct errors on our Online Store as soon as possible after becoming aware of them.
There are certain liabilities that cannot be excluded under applicable law. In particular, nothing in these Sales Terms limits the liability for personal injury or death, or liability for fraud. You might have certain rights under applicable consumer legislation explicitly prevailing the governing law hereof, including legal rights relating to faulty product(s). Nothing in these Terms will affect these explicitly prevailing legal rights.
SUBJECT TO THIS, IN NO EVENT WILL GLOBAL-E OR JET SET HAVE ANY LIABILITY FOR ANY OF YOUR LOSSES, ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, HOWSOEVER CAUSED INCLUDING ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH THESE TERMS. THE LIABILITY OF GLOBAL-E AND JET SET TO YOU FOR LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THESE TERMS WILL BE REDUCED OR LIMITED TO THE EXTENT (IF ANY) THAT YOU CAUSE OR CONTRIBUTE TO THE LOSS OR DAMAGE.
GLOBAL-E AND JET SET WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGES INCURRED BY UNAUTHORIZED USE OF YOUR PAYMENT CARD ON THE CHECKOUT, AND GLOBAL-E AND JET SET ARE NOT RESPONSIBLE FOR NOTIFYING YOUR CARD ISSUER OR ANY LAW ENFORCEMENT AUTHORITY IN THESE INSTANCES.
PLEASE NOTE THAT THESE SALES TERMS DO NOT AFFECT (AND SHOULD NOT BE READ TO AFFECT) YOUR STATUTORY RIGHTS WHICH CANNOT BE WAIVED OR LIMITED BY CONTRACT.
15. Intellectual property rights
All image, sound and text rights and trademarks used on the website of the Online store are the property of JET SET or the respective partners. A use of any kind without our express consent is strictly prohibited.
16. General
The Online Store may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Online Store and any transactions conducted on or through the Online Store.
JET SET and Global-e make no warranty that the Online Store will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and/or reliability of the Online Store. JET SET and Global-e will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Online Store.
If any provision or provisions of these Sales Terms shall be held to be invalid, illegal or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.

JET SET and Global-e reserve the right to access, read, preserve, and disclose any information that we obtain in connection with the Order, and your use of the Checkout, as JET SET and Global-e reasonably believe is necessary to: (i) satisfy any applicable law, regulation, legal process, subpoena or governmental request, (ii) enforce these Sales Terms, including to investigate potential violations of them, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to your support requests, or (v) protect the rights, property or safety of JET SET and Global-e, our users or the public.

18. Governing Law and Jurisdiction
These Sales Terms shall be governed and construed in accordance with the laws of Netherlands. The United Nations Convention on Contracts for the International Sale of Goods is excluded. Place of jurisdiction is Amsterdam, unless other local regulations prevail.
You are hereby informed that in the event of a dispute arising out of or relating to these Sales Terms, you may have a right under applicable law to file a complaint with an alternative dispute resolution institute. For customers resident in the EU, the European Commission provides a platform for Online Dispute Resolution (ODR), which can be found here [https://ec.europa.eu/consumers/odr/]. We are prepared to participate in out-of-court arbitration proceedings before a consumer arbitration board.
